
Lawyer Seeks Withdrawal Of Charge Against State Assemblyman In Wife Injury Case
BALIK PULAU: Lawyers representing Pantai Jerejak assemblyman Fahmi Zainol are preparing to submit a fresh representation to the prosecution seeking the withdrawal of charges linked to allegedly causing injury to his wife.
Defence counsel Shamsher Singh Thind said the legal team had only recently received the complete set of documents from the prosecution and is currently reviewing all related materials before formally submitting the representation.
According to him, the matter was informed to the court together with a request for a date to be fixed for the decision on the representation.
“However, the court maintained the trial date that had previously been set for August 18. If the representation is accepted, we will request an earlier date for disposal of the case,” he told reporters here today.
Earlier, Fahmi Zainol arrived at the Magistrate’s Court at around 9am accompanied by his lawyer for proceedings involving the submission of documents, including medical reports.
During earlier proceedings on April 28, the Magistrate’s Court fixed August 18 as the trial date and scheduled today for the handover of related documents.
Previously, the defence lawyer had reportedly requested that the case proceed without further delays after a two-month postponement was granted.
He also informed the court that the complainant had lodged two police reports before and after the alleged incident, while claiming there had been attempts to withdraw the reports.
On February 27, Fahmi Zainol was charged at the Balik Pulau Magistrate’s Court with intentionally causing injury to his wife, Nur Hidayah Abd. Jabar, 35.
The offence was allegedly committed at about 10pm on February 22 at a residence in Persiaran Pantai Jerejak 11, Bayan Lepas.
He pleaded not guilty to the charge framed under Section 323 of the Penal Code read together with Section 326A of the same code.
The court previously allowed the accused bail of RM2,000 with one surety pending further proceedings in the case.
