
High Court Ruling on Overloading Case Marks Landmark Enforcement Win for Terengganu JPJ
KUALA TERENGGANU — Road Transport Department Malaysia Terengganu has recorded a significant legal breakthrough after the High Court upheld both the conviction and sentence in a major overloading case, reinforcing enforcement powers and setting a new benchmark for regulatory compliance in the transport sector.
The case involved a transport company found guilty of breaching licensing conditions after operating a lorry carrying timber far beyond the permitted load limit. The High Court’s decision to dismiss the appeal effectively confirms the earlier ruling by the Kuala Berang Magistrate’s Court, which imposed a fine of RM11,000 and ordered the forfeiture of the vehicle involved.
Court Decision Strengthens Legal Precedent
Terengganu JPJ director Mohd Zamri Samion described the outcome as a defining moment for enforcement, noting that it establishes a clear precedent supporting asset forfeiture as a lawful penalty for serious regulatory violations.
The offence was prosecuted under provisions of the Land Public Transport Act 2010, specifically relating to breaches of operator licence conditions. The lorry in question was found to be overloaded by nearly 96 per cent, an extent of violation that significantly exceeds acceptable limits.
“This judgment confirms that the courts recognise the seriousness of overloading offences and are prepared to uphold strict penalties, including forfeiture of assets,” he said.
Extensive Trial Process Validates Enforcement Efforts
The case underwent a comprehensive trial spanning approximately one year, from September 2024 to September 2025, involving testimony from nine witnesses. The detailed proceedings reflect the level of scrutiny applied in establishing the facts of the case.
According to Mohd Zamri, this is the first instance in JPJ Terengganu’s history where a case of this nature progressed through a full trial and reached the High Court, with the forfeiture order ultimately maintained.
He emphasised that the outcome demonstrates the effectiveness of a structured enforcement approach backed by thorough evidence and legal procedure.
Shift in Industry Perception on Overloading Offences
The ruling is expected to reshape how overloading offences are perceived within the commercial transport industry. Traditionally, some operators have viewed fines as manageable costs associated with business operations.
However, the forfeiture of a vehicle introduces a far more severe consequence, directly affecting operational capacity and financial standing.
“This decision clearly signals that overloading cannot be treated as a minor infraction. The loss of a vehicle represents a substantial penalty that operators must take seriously,” Mohd Zamri said.
Asset Forfeiture as a Deterrent Mechanism
The enforcement approach highlighted in this case reflects a broader shift toward stronger deterrence measures. By targeting physical assets rather than relying solely on monetary fines, authorities are sending a clear message about the consequences of non-compliance.
