Military Officer to Be Charged Over Fatal Drunk Driving Case Involving Foreign Victim
PETALING JAYA, April 29 — A military officer suspected of driving under the influence of alcohol and causing the death of a Bangladeshi national is set to be charged in court tomorrow, following the completion and submission of investigation papers to prosecutors.
Attorney General Mohd Dusuki Mokhtar confirmed that the case file has been reviewed by his office, paving the way for formal charges to be brought against the suspect.
He indicated that the individual is expected to face charges under Section 302 of the Penal Code, a provision associated with serious offences involving loss of life.
“The investigation papers have been examined, and the matter will proceed to court for further action,” he said when speaking to reporters.
He added that additional charges may also be considered, as the incident reportedly involved not only a fatality but also injuries sustained by other individuals.
The case has drawn attention due to its severity and the circumstances surrounding the incident, which allegedly occurred on the MEX Highway in Kuala Lumpur. The crash resulted in the death of a foreign worker, raising broader concerns about road safety and enforcement against impaired driving.
Authorities had earlier extended the suspect’s remand period to facilitate further investigation, including forensic analysis and witness statements, before proceeding with prosecution.
Legal observers note that a charge under Section 302 carries significant weight, as prosecutors would need to establish key elements such as intent or awareness of risk leading to death.
As such, the case may serve as a critical reference point in shaping future legal interpretations of fatal drunk driving incidents and the application of severe criminal provisions.
Beyond its legal implications, the case has also sparked public interest due to the involvement of a uniformed officer, highlighting the importance of accountability and adherence to the law regardless of position or status.
