Hamzah Calls for Stronger Safeguards in Bills on Prosecutor Independence and Prime Minister Term Limits

KUALA LUMPUR, Feb 28 — Opposition Leader Datuk Seri Hamzah Zainudin has urged the government to strengthen proposed constitutional amendments involving the separation of the Public Prosecutor and Attorney General roles and the introduction of term limits for the prime minister, stressing the need for genuine institutional reform.

He said Opposition lawmakers had carefully reviewed the proposed legislation and identified several provisions that require further improvement before approval.

True independence must be protected

Hamzah said separating prosecutorial powers from the Attorney General’s office would be a major reform, but warned that its effectiveness depends on ensuring both offices operate independently.

He stressed that clear accountability mechanisms must be introduced to prevent abuse of authority.

He proposed that a bipartisan Parliamentary Select Committee oversee the appointment and removal of the Public Prosecutor.

The committee, he said, should also be empowered to call officials to explain prosecution policies while respecting the legal process.

Judicial review essential for accountability

Hamzah also called for prosecutorial decisions to be subject to judicial review.

He said this would strengthen checks and balances and prevent excessive concentration of power.

He warned that reforms must be meaningful and not merely symbolic.

Term limits must respect constitutional monarchy

On the proposed term limits for the prime minister, Hamzah emphasised that any amendment must respect the powers of the Yang di-Pertuan Agong.

He said changes affecting royal authority must receive approval from the Conference of Rulers.

This, he said, is necessary to preserve constitutional balance.

Separation of executive powers recommended

Hamzah also reiterated his view that the prime minister should not simultaneously serve as finance minister.

He said concentrating both roles in one person could undermine accountability.

He stressed that real reform must focus on strengthening institutions and ensuring transparent governance.
