
Lawyer Rejects Claims of Concealing Trustee Role in Dikim Foundation in Genting Family Dispute
KUALA LUMPUR: A lawyer involved in drafting the late Lim Siew Kim’s wills told the High Court she did not conceal her position as a trustee of the Dikim Foundation from the beneficiaries, as a high-profile family dispute continues.
Low Beng Choo, who prepared two wills for the deceased in 2022, said she had no intention of hiding her involvement with the foundation, despite questions raised during the reading of the will.
Testimony under cross-examination
During cross-examination by lawyer V. Sithambaram, representing two of the deceased’s daughters, Low acknowledged she did not personally respond when questions were raised about who managed the Dikim Foundation and who its trustees were.
She explained that although she was present during the discussion, others had already provided answers, and she did not see the need to respond further.
When it was suggested that she deliberately withheld information about her trustee role, Low rejected the claim.
“I do not agree,” she told the court.
Dispute over will validity and circumstances
The legal challenge has been brought by two daughters, who are questioning their mother’s mental capacity at the time the will was executed, as well as alleging irregularities in its preparation.
They have named several defendants in the case, including Low and their brother.
Questions over changes in financial provisions
The court also heard that Low was unaware of certain revisions made to the will, including a reduction in cash gifts allocated to the plaintiffs in a later draft.
She further said she did not have knowledge of details regarding the caregiving arrangements during the deceased’s illness, including hospital admissions.
When asked whether the will accurately reflected the deceased’s full assets, Low indicated it could be interpreted as the deceased allocating whatever she possessed at the time.
Hearing to continue
Lim Siew Kim, the daughter of Lim Goh Tong, passed away in July 2022 at the age of 73, leaving behind four children.
The case, heard before Judge Mahazan Mat Taib, is set to continue.
