The 12-year-old child driving the car pleaded not guilty
SEPANG: A 12-year-old boy whose video of him driving with his two younger siblings went viral was recently charged in the Magistrate’s Court here on Wednesday.
The child, as a person subject to a summons (OKS), pleaded not guilty to the charge of driving a Perodua Viva type car, on the road even though he was 12 years and three months old at the time of the incident.
He is alleged to have committed the act at the office of the Traffic Investigation and Enforcement Division, Sepang District Police Headquarters (IPD), here, at 6.30pm, 29 July.
The charge is brought under Section 39(1) of the Road Transport Act 1987 and can be punished under Section 39(5) of the same act, which carries a fine not exceeding RM2,000 or a maximum imprisonment of six months or both, if convicted.
The proceedings were conducted in private with the child accompanied by his mother.
In the same proceedings, his father, who is also a Pakistani national, is alleged to be the owner of the car, and was found to have allowed his son to drive the car, on the road, at the same location, time and date.
The charge is made in accordance with Section 39(5) of the Road Transport Act 1987, which carries a fine not exceeding RM2,000 or imprisonment for a period not exceeding six months or both.
The prosecution was conducted by Deputy Public Prosecutor, Nur Sabrina Zubairi while the defense for the two OKS was represented by lawyer, Nabilla Rosli from Messrs Nadia Nabilla Rosli & Syaakirah.
The court allowed the child to be bailed at RM500 while his father, who works as a carpet seller and has permanent resident status, was given RM2,000 bail with a local surety.
Magistrate, Muhammad Bukhori Md Ruslan fixed September 4 for the case to be mentioned again.
Previously, a viral video recording lasting one minute and 49 seconds went viral, showing a 12-year-old boy driving a Perodua Viva with two other boys, believed to be his younger brother.
