AGC rejects the representation of Israeli citizens to investigate allegations of possession of weapons, ammunition

KUALA LUMPUR: The Attorney General’s Department (AGC) rejected the representation submitted by Israeli citizen Avitan Shalom to review the two charges of possessing 200 rounds of ammunition and trading six firearms against him.

Deputy Public Prosecutor Mohamad Mustaffa P Kunyalam, when informing Sessions Court Judge Norina Zainol Abidin, said the representation had been submitted to the AGC on July 8.

Mohamad Mustaffa also asked the court to set another date for case management because there are two more documents that have not been handed over to the defence, namely the closed circuit camera (CCTV) report and the analysis of the forensic report.

“Following that, I suggest that the trial date set in the previous proceedings be maintained,” he said.

Previously, the court set Sept 30, Oct 1–3, and Oct 7–11 for the trial.

The court today also set Sept. 2 for the re-mention of the case.

Meanwhile, lawyer Datuk Naran Singh, who previously represented Avitan, 38, said he no longer represents the Israeli man for personal reasons.

“I will no longer appear on his behalf, but he (the accused) will be represented by another lawyer, Jeffrey Ooi,” he said.

Ooi, who appeared in court today, confirmed the matter.

According to the first amendment charge, Avitan is charged with possessing a box of Shell Shock NAS3 9mm containing eight rounds of ammunition and three boxes of Bullet Master Co. Ltd. containing 150 rounds of ammunition and 42 rounds of ammunition in three different weapons without a firearms license or permit pursuant to Section 8(a) of the Firearms Act 1960, which carries a prison sentence not exceeding seven years or a fine not exceeding RM10,000 or both.

The offense is charged in accordance with Section 7(1) of the Firearms (Heavier Penalty) Act 1971, which carries a prison sentence of not less than 30 years, not more than 40 years, and not less than six times.

The two offenses were allegedly committed in a hotel room in Jalan Ampang between 6.46 on March 26 and 6pm on March 28.
